Unless otherwise stated, all
products are warranted by the respective manufacturer to be free of defects in
material or workmanship, under normal use and operation. Defective parts,
subject to the inspection of the Manufacturer, will be replaced or repaired
during the warranty period on a no charge basis. Product that has been misused,
altered, damaged, maintained improperly, lost, exposure to corrosive environment,
or use other than intended will not be honored under this warranty. All
shipping costs related to returning the product to the Manufacturer for
inspection will be prepaid by the buyer. Shipping non-defective parts back to
the Buyer will be paid by the Buyer. All expenses, losses in revenue, and labor
charges arising or originating from the failure of defective parts will be
borne by the Buyer.
Any new product or accessory
branded with the Flexible Assembly name, and purchased from Flexible Assembly
Systems Inc, or through one of its authorized distributors or agents, is
warranted to the original buyer against defects in materials and workmanship for
a period of one (2) year* from date of delivery. Under the terms of this
warranty, Flexible Assembly Systems Inc will repair or replace any product or
accessory warranted hereunder and returned freight prepaid proving to Flexible
Assembly Systems Inc satisfaction to be defective as a result of workmanship or
materials. Product that has been misused, altered, damaged, maintained
improperly, lost, exposure to corrosive environment, or use other than intended
will not be honored under this warranty. In order to qualify for this warranty,
written notice to Flexible Assembly Systems Inc must be given immediately upon
discovery of such defect, at which time Flexible Assembly Systems Inc will
issue an authorization to return the product. The defective item must be
promptly returned to an authorized Flexible Assembly Systems Inc service center
with all freight charges prepaid. In NO event shall Flexible Assembly Systems
Inc be liable for any incidental and consequential damages in connection with
goods sold or any part thereof.
Warranty requests out of the stated
warranty period will not be acknowledged. Tools sent in under warranty are
subject to evaluation. Flexible Assembly systems Inc deems at its sole discretion
product that is eligible under warranty.
REPAIRED
PRODUCT WARRANTY
Flexible Assembly Systems offers
a 90 day warranty on parts and labor from the date of delivery for all serviced
or repaired product. Customers must contact Flexible Assembly Systems Inc
within the 90 day period for any issues with regards to the repair to redeem
warranty. Product that has been misused, altered, damaged, maintained
improperly, lost, exposure to corrosive environment, or use other than intended
will not be honored under this warranty. Any product that has been modified or
serviced under the warranty period by a technician that is not authorized by
Flexible Assembly Systems Inc will void the warranty.

EXCLUSION FROM WARRANTY This
warranty is valid only on products purchased from Flexible Assembly Systems Inc,
or thru its authorized distributors or agents. Flexible Assembly Systems Inc shall
have no obligation pursuant to the Flexible Assembly Systems Inc Warranty with
respect to any product or accessories which in Flexible Assembly Systems Inc sole
judgment have been misused, altered, damaged, maintained improperly, lost, exposure
to corrosive environment, or use other than intended will not be honored. This Warranty
is null and void if the customer, or any other person other than an authorized
representative of Flexible Assembly Systems Inc, has made any attempt to
service or modify the tool or accessory prior to its return to Flexible
Assembly Systems Inc under this Warranty. The warranty provision with respect
to each such product may be amended by Flexible Assembly Systems Inc from time
to time in its sole discretion. The liability of Flexible Assembly Systems Inc
hereunder shall be limited to replacing or repairing, at its option, any
products which are returned freight prepaid to Flexible Assembly Systems Inc
and which Flexible Assembly Systems Inc determines to be defective as described
above or, at Flexible Assembly Systems Inc option, refunding the purchase price
of such products. Flexible Assembly Systems Inc reserves the right to make
periodic changes in construction or tool design at any time. Flexible Assembly
Systems Inc specifically reserves the right to make these changes without
incurring any obligation or incorporating such changes or updates in tools or
parts previously distributed.
THE FLEXIBLE ASSEMBLY SYSTEMS INC
WARRANTY IS IN LIEU OF ALL OTHERWARRANTIES, EXPRESSED OR IMPLIED, AND FLEXIBLE
ASSEMBLY SYSTEMS INC EXPRESSLY DISCLAIMS ANYWARRANTY OF MERCHANTABILITY OR
FITNESS FOR A PARTICULAR PURPOSE. THISWARRANTY SETS FORTH THE SOLE AND
EXCLUSIVE REMEDY IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE. THIS WARRANTY
IS THE ONLYWARRANTY MADE BY FLEXIBLE ASSEMBLY SYSTEMS INC WITH RESPECT TO THE
GOODS DELIVERED HEREUNDER, AND MAY BE MODIFIED OR AMENDED ONLY BY AWRITTEN
INSTRUMENT SIGNED BY A DULY AUTHORIZED OFFICER OF FLEXIBLE ASSEMBLY SYSTEMS INC.
LIMITATION OF LIABILITY
FLEXIBLE ASSEMBLY SYSTEMS INC
LIABILITY PURSUANT TO WARRANTY OF THE PRODUCTS COVERED HEREUNDER IS LIMITED TO
REFUND OF THE PURCHASE PRICE. IN NO EVENT SHALL FLEXIBLE ASSEMBLY SYSTEMS INC
BE LIABLE FOR COSTS OF PROCUREMENT OF SUBSTITUTE GOODS BY THE BUYER. IN NO
EVENT SHALL FLEXIBLE ASSEMBLY SYSTEMS INC BE LIABLE FOR ANY SPECIAL,
CONSEQUENTIAL, INCIDENTAL OR OTHER DAMAGES (INCLUDING WITHOUT LIMITATION, LOSS
OF PROFIT) WHETHER OR NOT FLEXIBLE ASSEMBLY SYSTEMS INC HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH LOSS, HOWEVER CAUSED, WHETHER FOR BREACH OR REPUDIATION OF
CONTRACT, BREACH OFWARRANTY, NEGLIGENCE OR OTHERWISE. THIS EXCLUSION ALSO
INCLUDES ANY LIABILITY WHICH MAY ARISE OUT OF THIRD PARTY CLAIMS AGAINST BUYER.
THE ESSENTIAL PURPOSE OF THIS PROVISION IS TO LIMIT THE POTENTIAL LIABILITY OF FLEXIBLE
ASSEMBLY SYSTEMS INC ARISING OUT OF THIS AGREEMENT AND/OR SALE.
Note: The Flexible Assembly
Systems Inc Warranty confers specific legal rights, however some states or
jurisdictions may not allow certain exclusions or limitations within this
warranty.
